Transfer Pricing is a challenging tax issue. Related to the pricing of internal transactions between related companies or branches, transfer pricing covers a wide range of issues – such as the provision of services, the cross-border use of information technology systems, or financial transactions involving more than one country. Companies address this by the use of intercompany service agreements and various types of transfer pricing documentation.

The tax guidelines for transfer pricing are outlined by the Organization for Economic Co-operation and Development (OECD), which requires that internal pricing policies are consistent with the pricing of comparable transactions between unrelated parties. UK Immigration Reform News
January 14, 2008

The first phase of a new points-based system will go into effect April 2008. Aimed at clearing up a confusing range of entry routes and designed to work with tightened immigration controls, the new regulations use objective criteria for determining potential employee suitability, allowing the UK to respond flexibly to changes in the labor market.

Under the new rules, all UK businesses employing non-EU nationals will be required to register as certified sponsors of prospective employees. The ability of all such “sponsor” companies to grant their own work permits has the potential to streamline the immigration and employment process. It will, however, also place much of the document certification onus on the employer, and penalties for errors and non-compliance are severe. more >>
Chinese labor law changes
January 7, 2008

A new labor contract law (LCL) went into effect January 1, 2008. Aimed at improving job security for workers, the legislation limits overtime, sets minimum wages, makes open-ended terms of employment for long-time workers, requires employers to contribute to their employees’ social security accounts, sets restrictions on the use of non-competition agreements, and guarantees one month’s pay for each year worked for terminated employees. Adopted last June, the 98-article law is the first time that the Chinese top legislature has ruled on open-ended work contracts and severance pay for fired workers. Client notice regarding electronic signatures in the EU

A couple of reminders about electronic signature requirements in the UK and Germany:

I.  HSP clients should be advised that every UK company, regardless of size, needs to list its company registration number, place of registration and registered office address on its website and in its emails. This information is already required on business letters, but regulations also extend it to websites, order forms and electronic documents, including email. Directors of companies that breach the new Companies Act risk a fine of up to £1,000, so please amend your email templates accordingly.

Do note that these regulations extend to UK limited companies, so clients sending out emails in the name of their UK limited company should routinely include... more >>
